A PROCLAMATIGN DECLARING A PARCEL OF LAND OF THE PUBLIC DOMAIN IN SITIO BINAKAY, BARANGAY TALACDAN, MUNICIPALITY OG CAUAYAN, PROVINCE OF NEGROS OCCIDENTAL, ISLAND) OF NEGROS, AS CIVIL RESERVATION FOR HOUSING AND RESETTLEMENT SITES PURPOSES TO BE IMPLEMENTED YHROUGH THE KAPIT-BISIG LABAN' SA XAHIRAPAN IN CONFLICT AREAS (KALAHI-CA)

Upon the recommendation of the Secretary of Environment and Natural Resources and by virtue of the powers vested in me by iaw, I, GLORIA MACAPAGAL-ARROYO, President of the Repubiic of the Philippines, do hereby declare a certain parce! of tand of the public domain situated in Sitio Binakay, Barangay Talacdan, Municipality of Ceuayan, Province of Negros Occidental, Island of Negros, containing an aggregate area of ONE HURORED SIXTY ONE THOUSAND TWO HUNDRED SIXTY SEVEN (241,267) SQUARE METERS, as Civil Reservation for housing and resettlement sites purposes to be implemented through the Kapit-Bisig Laban sa Kahirapan in Conflict Areas (KALAHI-CA) under the administration of the Department of Environment and Natural Resources, subject to future reclassification to alienable and disposable land, which parcel of land is more particularly described as follows:

A PARCEL OF LAND (Plan NR-06-00030) situated in Talacdan, Cauayan, Province of Negros Occidental, Island of Negros. Bounded on the NE., along lines 1-2-3 by Forest Zone; on the SW., along lines 3-4-5-6-7-8-9-10 by Binacay Creek; on the NW., along lines 10-11-12-1 by Forest Zone.

Beginning at a point marked “1” on plan being N. 38 deg. 38' W., 3,687.87 meters from BLLM no. 117, PLS-69, thence:

S. 08 dea. 59’ W., 100.80 m. to point 3;

N, 73 deg. 57’ W., 35.16 m. to point 4;

S. 37 deg. 52’ W., 155.16 m. to point 5;

beginning, containing an area of ONE HUNDRED SIXTY ONE THOUSAND TWO HUNDRED SIXTY SEVEN (161,267) SQUARE METERS, more or less.

The points referred to above are indicated on plan and are marked on the ground by old. points, bearing true surveyed by Geodetic Engineer Normandy K. Lebelo surveyed on March 29, 2005 and approved on July 01, 2005.

• Note: EASEMENT FOR PUBLIC USE (20.06 m. wide) along lines 3 to 10 is reserved.

‘The area therein reserved as Civil Reservation for resettlement and agricultural site purposes shall not be used for any other purpose. However, beneficiaries may be awarded with special land use permits in accordance with the provisions of Presidential Decree No. 705 otherwise known as the Forestry Code of the Philippines.

Existing Laws, rules and regulations affecting salvage zones and foreshore areas shall be strictly enforced. As such, the forty (40) meter easement shall be maintained as environmental protection open area.

The cutting, gathering and utilization of all natural resources within the proclaimed site shall be subject to existing DENR rules and regulations.
