• MALACANANG Manila BY THE PRESIDENT OF THE PHILIPPINES PROCLAMATION NO. .1160 AMENDING PROCLAMATION NO. 458, DATED AUGUST 29, 1994, "RESERVING THE FOREGOING TWENTY PARCELS OF LAND AT MANGGAHAN FLOODWAY COMPLEX FOR THE CONSTRUCTION OF MEDIUM RISE SOCIALIZED AND LOW COST HOUSING PROJECT AND ITS ALLIED STRUCTURES FOR THE BENEFIT OF SOME 6,700 URBAN POOR FAMILIES AND THE DESERVING LANDLESS- HOMELESS EMPLOYEES OF THE PROVINCIAL GOVERNMENT OFRIZAL " WHEREAS, there is an urgent need to further strengthen the implementation of controlling the escalating squatting at the Berm slope of the Manggahan Channel and the continuous devastation of the environment in the area; WHEREAS, despite of the Ordinance and Laws regarding Anti-squatting, the Municipal and City Government have no consistent drive against informal settling but instead contributed by tolerating such illegal act at their respective area of jurisdiction; WHEREAS, this illegal act contributed mainly in the pollution of the channel and the Laguna Lake, ,devastating the environmental sanitation and ecological significance of the area' and the aquatic resources and marine life of the Lake through discharging of garbage and sewer waste directly into the channel; WHEREASr this act cannot be tolerated much less sanctioned by the Government( otherwise the implementation of the Anti-squatting Law and the Clean and Green objective will be frustrated and therefore, an amendment to this effect is an Order; NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines and by virtue of the power vested in me by law and in relation to the recommendations of the Provincial Government of Rizal' and other agencies of the government, PCRGA, PCUP" COA, OENR to the draft feasibility study submitted by P .C. In order to facilitate the early development of the area, the Department of Environment and Natural Resources through the Regional Office, Region .IV and the Department of Public Works and Highways, are hereby directed to undertake immedia,tely the final survey of the area for the early development and completion of the project. Upon submission of the final feasibility study, the Home Guaranty Corporation is likewise directed to issue a Guaranty Certificate requirement of the investor but in strict control and supervision of the Housing and Urban Development Coordinating Council. The Land Management Bureau shall issue Special Patent in favor of the Home Along the Floodway Project, declaring the same to be utilized exclusively for the perpetual use for housing and development and allied structures, while the segregated portion from PPN 458 shall be used for livelihood projects and sanitary waste disposal facilities, such as garbage segregation and decomposing system and the necessary waste water treatment plant to safeguard the sanitary protection of the environment and preservation of the Laguna Lake. The beneficiaries under this proclamat.ion shall nQt be the subject for alienation, conveyance and encumbrance or leased for a period of ten (10) years from the issue of the Deed of ConVeYance except in favor of the government or as determined by the Government agency concerned.
