PROCLAMATION NO. 1395

DECLARING CERTAIN PARCELS OF LAND OF THE UNIVERSITY OF THE PHILIPPINES LOCATED IN BARANGAY U.P. CAMPUS, DILIMAN, QUEZON CITY AS ACCESS HIGHWAY FOR THE IMPLEMENTATION OF C- 5 EXTENSION PROJECT THAT WILL CONNECT THE NORTH LUZON EXPRESSWAY (NLEX) AND THE SOUTH LUZON EXPRESSWAY (SLEX)

WHEREAS, there is an urgent need to interconnect the SLEX and NLEX to accelerate the socio-economic growth end development of the Metro Luzon Urban Beltway Super Region;

WHEREAS, pursuant to Presidential Memorandum dated July 17, 2007 and as announced during the State of the Nation Address, the implementation of the Circumferential Road 5 (C-5) Extension Project was approved, a segment of which will traverse a portion of the U.P. Diliman properties:

WHEREAS, this new road alignment of the C-5 Extension Project. will generate significant cost-savings in favor of the government;

WHEREAS, these areas, Pook Ricarte, Pook Palaris and Pook Dagohoy (RIPADA areas) to be traversed by the new road alignment are now occupied by retired and active U.P. employees and other informal setters,

WHEREAS, there is a growing clarnor to pursue the physical and socio- economic development of these areas of U.P. Diliman towards becoming a model urban community having been declared as an Aréa for Priority Development under Presidential Proclamation No. 1967;

WHEREAS, tnis new road alignment will protect U.P. from further and unwarranted intrusion and its development will provide better access to U.P. and ennance the value of its properties;

WHEREAS, considering that the RIPADA areas are now within the exclusive jurisdiction of U.P., said areas cannot be effectively serviced by the Local Government of Quezon City, which if separated from U.P., the City Government could directly help and alleviate the financial burden of U.P.:

2. As housing facilities for deserving and bonafide occupants, to include those active and retired UP employees presently residing in the said cornamunities with an area of FORTY SIX THOUSAND FIVE HUNDPED . SIXTY THREE (46,563) SQUARE METERS, more or less.

Specifically, the METROPOLITAN MANILA DEVELOPMENT AUTHORITY, pursuant to its mandated functions on transport and traffic management, and the development of shelter and housing facilities among others, in the delivery of metro-wide services as specified in Items (b) and (e) of R.A. 7924, and being the Regional Development Council in NCR per Executive Order 113, is hereby tasked to perform and execute the following activities under the direct supervision of the OFFICE OF ‘THE PRESIDENT, to ensure the effective and efficient implementation of this Proclamation, stated to wit:

1. Preparation of Detailed Engineering Plans and Designs for the construction of the access highway for the new road alignment of the C-5 Extension Project in coordination with the Department of Public Works and Highways (DPWH).

2. Preparation of a Comprehensive Development Plan for housing facilities for the affected families: of the areas. MMDA is authorized to tap and solicit the assistance and support services of concerned government agencies to implement the total development of the areas, including the conduct of parcellary and topographic surveys in coordination with the Land Registration Authority and Land Management Bureau, DENR.

3. Formulation, adoption, and implementation of guidelines, rules and regulations pertaining’ to land disposition such as qualifications of beneficiaries, lot pricing, financing scheme, awarding of lots and facilities, required financial plans, and other related procedures,

4. Any and all proceeds to be generated from the land disposition shall accrue and be utilized for the development and general welfare of the community and of the University of the Philippines.

All previous issuances inconsistent with the provisions of this Proclamation shall be deemed repealed and/or modified accordingly.
