EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 423 DATER JULY 12, 1957, WHICH ESTABLISHED THE MILITARY RESERVATION KNOWN 4S FORT WILLIAM MCKINLEY (NOW FORT -ANDRES BONTFACIO) SITUATED IN THR MUNICIPALITIES oF PASIG, TACUIG, FATEROSS AND PARANAQUE, PROVINCE OF RIZAL AND PASAY CITY (NOW METROPOLITAN NANILA), AS AMENDED BY PROCLAMATION NO. 2476 DATED JANUARY 7, 1986, CERTAIN PORTIONS OF LAND EMBRACED THEREIN KNOWN AS BARANGAYS LOWER BICUTAN, UPPER BICUTAN, WESTERN BICUTAN AND SIGNAL VILLAGE SITUATED IN THE MUNTCIPALITY OF TAGUIG, METROPOLITAN MANILA AND DECLARING THE SAME OPEN FOR DISPOSITION UNDER THR FROVISIONS OF REPUBLIC ACT NO. 274 AND REPUBLIC ACT NO. 730 IN RELATION TO THE PROVISIONS OF THE PUBLIC LAND ACT, AS AMENDED; AND PROVIDING Tih IMPLEMENTING. GUIDELINES.

Upon the recommendation of the Secretary of Environment and Natural Resources; and by virtue of the powers: vested in me by law, I, CORAZON C. AQUINO, President of the Philippines, dec hereby exclude from the eperation of Proclamation Ne. 423 dated duly 12, 2957, which established the Military reservation known as Fort William Mckinley (now Fort Andres Bonifacio) situated in the municipalities of Pasig, Taguig, Pateros, and Paranaque, Province of Rizal and Pasay City (now all of Metropelitan Manila), as amended by Proclamation No. 2476 dated January 7, i386, certain porticns of the land embraced therein (subject to accual survey) known and identified as the regular barangays of Lower Bicutan, Upper Bicutan, Western Bicutan and Signal Village, situated in the Municipality of Taguig, Metropolitan Manila and Geclare the same open fer disposition in accordance with Republic Act Ne. 274 and Republic Act No. 730 in. relation to the provisions ef the Public Land Act, as amended.

Any provision of law to the contrary notwithstanding, this position of lots under this Proclamation covering the titled portion of the reservation shall be exempt from the usual publication and open public bidding requirements under Act 3038 and shall be disposed of in the manner and under the conditions prescribed under Republic Act No. 730.

Such part or parts of the area herein declared open to this position under Republic Act No; 274 and Republic Act No. 730 in relation to the provisions of the Public Land Act which are heing used or earmarked for public or quasi-public putposes shall be excluded from such disposition. Except in favor of the government or any of its branches or agencies, all lands disposed of under this Proclamation shall not be subject to alienation and encumbrance for a term of ten (10)years from the issuance of title in case of sale, or execution of contract in case of lease, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period except for housing loan purposes, but the improvements on the land may be mortgaged to qualified persons, associations, or corporations.

No alienation, transfer or conveyance of any land covered by this proclamation shall be made witnin ten (10) years after issuance of title, provided that such alienations, transfer or conveyance may be made after ten (10) years but before twenty- five (25) years after issuance of the title upon approval of the Secretary of Environment and Natural Resources, through the Director of Lands, which approval shall not be denied except on constitutional and legal grounds.
