PROCLAMATION NO. 174

EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 287, DATED AUGUST 14, 1964, A CERTAIN PARCEL OF LAND CF THE PUBLIC DOMAIN SITUATED IN THE MUNICIPALITY OF SOUTH UPI, PROVINCE C# MAGUINDANAO, AND DECLARING SAME AS ALIENABLE OR DIS- POSABLS FOR TOWNSITE PURPOSES.

Upon recommendation of the Secretary of Environment and Natural Resources, and pursuant to the authority vested in me by law, I, CORAZON C. AQUINO, President of the Phil- ippines, co hereby exclude from the operation of Proclamation No. 287, dated August 14, 1964, which established the Mount Talayan Forest Reserve, md declare as alienable and dis-— posatle for townsite purposes, subject to the provision of the Public Land Act and to upplicable laws and regulations governing townsite settlemént, a certain parcel of land embraced therein situated in the Municipality of South Upi, Province of Maguindanao, as shown in Bureau of Forest Develop- ment Map No. Maguindanao PMD No. 12-001 and technically described, to wit:

thence Ii 71°, 460 meters to point of beginning, con- taining an area of approximetely THREE HUNDRED FIFTY EIGHT (358) HECTARES. All points referred to are marked on the ground accordingly. Bearings magnetic, date of survey, vuly 2-8, 1980, and subject further to the following conditions:

1. A strip of 15 meters in width on each side of any public trail therein used as outlet for timber and other forest products, and a strip of 20 meters in width on each side from the highest bank of any stream are hereby retained as forest lands and must be maintained under permanent forest cover.

2. The extraction and utilization of any forest products remaining on the area herein excluded/ declared alienable or disposable lands shall be subject to Forest and Internal Revenue Laws and Regulation.

3. Naturally grown trees still remaining after the area herein declered alienable or dis- posable land nas been occupied and developed shall no longer be cut or harvested but shall be maintained and preserved as part of ‘the permanent vegetation for areas to be reserved as Greenbelt pursuant to Letter of Instruction No. 917 and its implementing rules and guide- lines.

4. The Regional Director of Environment and Natural Resources, in coordination with the local zovern— ment officials concerned shall identify and delineate areas to be established, developed and maintained as forest or tree parks for the muni- cipality or barangays therein, pursuant to Letter or Instruction No. 1312 and its implementing rules and regulations.
