I e\sv'*ff/.-- BY THE PRESIDENT OF THE PHILIPPINES PROCLAMATION NO. 18 DECLARING A STATE OF CALAMITY IN SILAY CITY, NEGROS OCCIDENTAL Upon recommendation of the Secretary of National Defense as Chairman of the National Disaster Coordinating Council, and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Philippines, do hereby declare a state of calamity in Silay City, Negros Occidental in view of the extensive damage to properties and massive displacement of families caused by the flooding incident last January 15,2001. All departments and other government agencies concerned are hereby directed to implement and execute relief and rehabilitation work in accordance with existing opera- tional plans and directives and orders issued in connection with calamities. DULJO FATIMA, CEBU CITY AND DECLARING THE SAME OPEN FOR DISPOSITION TO ITS BONAFIDE OCCUPANTS WHEREAS, in line with the priority concern of the Government to provide housing to homeless Filipinos and consistent with the constitutional mandate for the State to protect and advance the right of the people to a balanced and healthful ecology, decent living conditions and socialjustice; WHEREAS, mass housing has been reaffirnred by this government as a centerpiece program in its poverty alleviation efforts pursuant to Executive Order No. 20 dated 28 May 2001; WHEREAS, mass housing may be effected, among others, through the regularization of land tenure of informal settlers on government-owned lands which have not been used for the purposes for which they have been reserved or set aside for the past ten (10) years from the effectivity of UDHA pursuant to Executive Order No. 131 dated 01 October 2002; WHEREAS, such initiative showcases this Administration's seriousness in its anti-poverty strategies, particularly on assets reform that directs the redistribution of physical assets to the poor. 'Except in favor of the Government or any of its branches or agenci"ds, all land disposed of under this proclamation shall not be subject to alienation and encumbrance for a term of ten (10) years from the issuance of title in case of sale, or execution of contract in case of lease, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period; but the improvements on the land may be mortgaged to qualified persons, associations or corporations. It is likewise required that the necessary right-of-way and 3-meter basement along the Kinalumsan River be provided for. The Housing and Urban Development Coordinating Council (HUDCC) shall take the lead in implementing the provisions of this Proclamation in coordination with the Department of Environment and Natural Resources (DENR), concerned Local Government Unit and other relevant agencies and stakeholders. lN WITNESS THEREOF, I have hereunto set my hand and caused the seal of the Republic of the Philippines to be affixed.
