MALACANANG MANILA lit p.,.; rA7 PROCLAMATION NO. 4 RESERVING FOR THE PURPOSE OF ESTABLISHING A SETTLEMENT AND AN AGRICULTURAL COMMUNITY UNDER THE AGRARIAN REFORM COMMUNITY PROGRAM OF THE DEPARTMENT OF AGRARIAN REFORM CERTAIN PARCELS OF LAND OF THE PUBLIC DOMAIN SITUATED IN THE MUNICIPALITIES OF BUNAWAN AND VERUELA (LOCALLY NAMED NUEVA ERA), PROVINCE OF AGUSAN DEL SUR WHEREAS, Section 85, Chapter XII, Title 5 of Commonwealth -c No. 141, approved 7 November 1936, otherwise known as the "Publi.:: Land Act", authorizes the President to designate, by proclamation any tract or tracts of land of the public domain for th establishment of agricultural communities; WHEREAS, Section 14, Chapter 4, Title I, Book III of the Administrative Code of 1987 provides that "[t]he President shall have the power to reserve for settlement or public use, and fa:=- specific public purposes, any of the lands of the public domain, the use of which is not otherwise directed by law. The reserved land shall thereafter remain subject to the specific public purpose indicated until otherwise provided by law or proclamation"; WHEREAS, Section 3(5), Chapter 1, Title XI, Book IV of the Administrative Code of 1987 provides that the Department of Agrarian Reform shall "[a]dminister and dispose of" under a settlement scheme all portions of the public domain declared as alienable and disposable lands for speedy distribution to and development by deserving and qualified persons who do not own any- land and under such terms and conditions as the Department ma~ prescribe, giving priority to qualified and deserving farmers i; the province where such lands are located"; WHEREAS, it is the declared policy of the state to provide avigorous land resettlement program in order to create a tru.l viable social and economic structure in the country; - WHEREAS, it is the responsibility of the government to provide the people with lands as well as technical guidance and assistance to make them independent, self-reliant and responsible citizer~: and WHEREAS, there is a big tract of agricultural land in Buna~~ and Veruela, Agusan del Sur found to be suitable for cultivatio~ and conversion into a well-organized and developed resettlemen~ area for landless farmers, rebel-returnees, evacuees and o~'1e=:,.. deserving Filipinos. ~~ 933455 NOW, THEREFORE, I, FIDEL V.
