Proclamation No. 295, s. 1993 - Signed on November 9, 1993: Excluding from the operation of Executive Order No. 63, dated 25 June 1914, and Proclamation No. 391, dated 13 March 1939, which established the Mineral Land Reservation in the province of Surigao, island of Mindanao certain alienable and disposable parcels of land embraced therein, and declaring the same open to disposition under the Comprehensive Agrarian Reform Program of the Department of Agrarian Reform and other pertinent laws relative to titling of lands not suitable for agriculture.

WHEREAS, Executive Order Proclamation No. 391, dated 13 of'land in the Province ofMineral Land Reservation; No. 63, dated 25 June 1914 and 1939 established certain parcelsSurigao, Island of Mindanao, as WHEREAS, the residents of the parcels of lands covered by this Proclamation have, since 1988, petitioned the Government for the coverage of said parcels under the agrarian re£ormprogram; WHEREAS, the Secretaries of the Departments of Environment. and Natural Resources and o£ Agrarian Reform have (",ntered into a Memorandum of Agreement to conduct geologjcal surveys for the determination of lands -classifie'ct as Al ienable and Disposable and those suitable for _-esidcntial purposes; WHEREAS, portions of the said alienable and disposable lands described herein have been utilized for agricultural, community development (barangayjmunicipal) or residential purposes by the long-term se"ttlers in the said lands; WHEREAS" the aforementioned portions of the Mineral LandReservation have been classified as alienable and disposable under variou Land' Clas,sif icat ion Maps; WHEREAS, the findings of the Director of Mines and Geosciences sho,;. that pol-tions of the areas. covered by the said Minera 1 s Lancl Reservat 10r1" tta!e been explored to have low geological potential for miner:1!ls and: there.fore remain undeveloped for mining purposes; WHEREASI Decree No. under the p,rovrsions o,t., sectioft 6 of P'res,idefttia,l 6}',.. a.s amend'ed,.. o;ther.f'l,se kftOl,-ln a,s the, M'lfteral Resources Development Decree of 1974, the Pres'ident may alter or modify the boundaries of an area established as mineral reservation or revert any mineral reservation to the public domain without prejudice to any prior subsisting rOights, upon the recommendation of the Minister (now the Secretary of the Department of Environment adn Natural Resources) based on the report submitted by the Director of the Mines and GeosciencesBureau; WHEREAS, Executive Order No. 448 as amended by Executive Order No. 506 of 1992 provides that "Except national parks and other protected areas, all lands or portions of the public domain reserved by virtue of proclamation or law for specific purposes or uses by Departments, bureaus and agencies of the Government, which are suitable for agriculture and no longer actually, directly and exclusively used or necessary for the purpose for which they have been reserved. ..shall be segregated from thereservations, nd transferred to the DeRartment of Agrarian Reform for distribution to qualified beneficiaries under the Comprehensive Agrarian Reform Program." NOW, THEREFORE, upon the recommendation of the Secretary ofthe Department of Environment and Natural Resources, and the Secretary of the Department of Agrarian Reform, based on the report submitted by the Director of the Mines and GeosciencesBureau, and pursuant to the provisions of Section 6 ofPresidential Decree No. 463, otherwise known as the MineralResources Development Decree of 1974, and Executive Order No. 506of 1992, I, FIDEL V.
