PROCLAMATION NO. 363

AMENDING THE COVERAGE OF PROCLAMATION NO. 528 DATED FEBRUARY 26, 1969, WHICH ESTABLISHED THE MALANGAS COAL MINES RESERVATION IN THE MUNICIPALITIES OF KABASALAN, SIAY, PAYAO, ALICIA, MALANGAS, DIPLAHAN,. BUUG, BAYOG, IMELDA AND SALAGMANOK, ALL OF ZAMBOANGA DEL SUR, ISLAND OF MINDANAO

WHEREAS, petitions are being vigorously filed time and again for the release of an extensive parcel of land in the Municipalities of Kabasalan, Siay, Alicia, Malangas, Diplahan, Buug, Bayog, Imelda and Salagmanok, all of the Province of Zamboanga del Sur, from the operation of as the Malangas Coal Mines Reservation, originally established under Proclamation No. 284, dated July 19, 1938, as amended by Proclamation No. 402, dated June 27, 1953, Proclamation No. 528, dated February 26, 1969, and Proclamation No. 223, dated February 29, 1988;

WHEREAS, the remaining 58,590 hectares, more or less, of the Reservation embrace rich agricultural farmlands straddling both sides of the imposing Sibuguey River Valley, which have been occupied since time immemorial, while some portions thereof have become urbanized community centers;

WHEREAS, in almost a century of coal exploration and extraction within the original Reservation, only a small portion thereof has been mined, while the continued presence of the Proclamation has stunted opportunities for development and other land uses of the rests of the area;

NOW, THEREFORE, upon recommendation of the Secretary of Energy and Secretary of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, JOSEPH EJERCITO ESTRADA, President of the Philippines, do hereby amend Proclamation No. 528 dated February 26, 1969, to cover only Parcels I and I thereof, where there are significantly more concentration of coal deposits, and Parcel III thereof, which will serve as'a port area for coal shipments, to continue as the Malangas Coal Mines Reservation, withdrawn from sale, entry, settlement and alienation, under the administration of the Department of Energy, subject to private rights if any there be and to final survey for Parcels I and II, as described hereunder:

The rest of the area, except that covered by Proclamation No. 890 establishing a mineral reservation in Alicia, Zamboanga del Sur, are hereby excluded from the operation of Proclamation No. 528 and shall henceforth revert to the mass of the public domain for disposition under the Public Land Act.

To protect and safeguard the best interest and welfare of the State, the Government of the Republic of the Philippines hereby reiterates its reserved right to develop and extract the coal deposits of commercial value that may hereafter be discovered within the areas hereby released, upon payment of just compensation for improvements introduced in good faith on the premises.
