PROCLAMATION NO. 403

DECLARING A PARCEL OF LAND OF THE PUBLIC DOMAIN LOCATED IN PUROK 6, DIATAGON, LIANGA, SURIGAO DEL SUR AS SOCIALIZED HOUSING SITE UNDER THE ADMINISTRATION OF THE NATIONAL HOUSING AUTHORITY AND PROVIDING FOR ITS DISPOSITION TO BONAFIDE OCCUPANTS IN ACCORDANCE WITH THE PROVISIONS OF REPUBLIC ACT NO. 7279 (URBAN DEVELOPMENT AND HOUSING ACT)

WHEREAS, it is the priority concern of the Government to provide housing to homeless Filipinos in line with the constitutional mandate for the State to protect and advance the right of the people to a balanced and healthful ecology, decent living conditions and social justice;

WHEREAS, Executive Order No. 131, s. 2002, established mechanism implementing the provisions of Republic Act No. 7279, otherwise known as the Urban Development and Housing Act of 1992, to dispose of as socialized housing sites/ lots government-owned lands that have not been used for the purposes for which they have been set aside for the “past ten (10) years” (reckoned from 1992, when Republic Act No. 7279 took effect) and are suitable for socialized housing;

WHEREAS, pursuant to Section 5 of Executive Order No. 131, s. 2002, the NHA, under the supervision of HUDCC, shall take the lead in the disposition of the lands declared as socialized housing sites under UDHA.

NOW, THEREFORE, I GLORIA MACAPAGAL-ARROYO, President of the Philippines, do hereby declare 273,971 square meters of public land located in Purok 6, Diatagon, Lianga, Surigao Del Sur as socialized housing site under the administration of the National Housing Authority and providing for its disposition to actual bona fide occupants in accordance with the provisions of RA 7279, subject to private rights, if any there be, and to final survey, which portions of land are more particularly described as follows:

Except in favor of the Government of any of its branches or agencies, all lands disposed under this Proclamation shall not be subject to alienation and encumbrance for a term of ten (10) years from the issuance of the title in case of sale, or execution of contract in case of lease, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period; but the _ improvements on the land may be mortgaged to qualified persons, associations or corporations.

A 20-meter road right-of-way along the national road shall strictly be observed in the preparation of the site development plan.

For purposes of formulating the guidelines for the disposition and implementation of a comprehensive housing plan for the area, a Local Inter Agency Committee is hereby created to be chaired by HUDCC and co-chaired by the Provincial Government of Surigao del Sur with the following agencies as members:

1. Municipal Government of Lianga;

2. Department of Environment and Natural Resources;

3. Presidential Commission for the Urban Poor and

4. A representative from a non-government organization
