RESERVING FOR PUBLIC USE FOR VARIOUS BARANGAY DEVELOPMENT PROJECTS PARCELS OF LAND OF THE PUBLIC DOMAIN SITUATED IN BARANGAY PUNTALINAO, MUNICIPALITY OF BANAYBANAY, PROVINCE OF DAVAO ORIENTAL, ISLAND OF MINDANAO

Upon recommendation of the Secretary of Environment and Natural Resources and by virtue of the powers vested in me by law, I, JOSEPH EJERCITO ESTRADA, President of the Philippines, do hereby reserve for public use under the administration of the Local Government of Banaybanay, Davao Oriental, certain parcels of land of the public domain situated in Barangay Puntalinao, Municipality of Banaybanay, Province of Davao Oriental, Island of Mindanao, which are particularly described as follows:

A parcel of land (Lot No. 1, MR-112502-000026, Amd.) situated in Barangay Puntalinao, Municipality of Banaybanay, Province of Davao Oriental, Island of Mindanao. Bounded on the North-North East along line 1-2 by lot 2 of plan MR-112502- 000026, Amd.; on the South along lines 2-3-4-5-6-7-8-9 by National Highway (60.00 meters wide); on the West along line 9-10 and on the North along line 10-1 by Davao’ Gulf. No cutting of trees or clump of trees shall be allowed without clearance from the Department of Environment and Natural Resources. The development, construction, use and/or operation of any facility that may be established within the parcel of land shall be subjected to environmental control and management. As such an initial Environmental Examination or Environmental Impact Assessment, whichever is applicable, shall be required in any development/construction of the area. The strip of forty (40) meters of the area along Davao Gulf'shall be preserved for bank protection.

Lot | shall be utilized only for public use intended for Multi-Purpose Center and Pavement, Market Site, Day Care Center, Park and Plaza and such other needs as the Barangay Council may determine conductive to the approved Barangay/Municipal Development Plan.

Lot 3, MR-112502-000026, Amd. shall be used as mini-forest and reforestation area and shall serve as buffer zone area of the Barangay.

A Barangay Development Plan must be prepared by the Barangay Council duly indorsed by the Municipal Development Council to the Department of Environment and Natural Resources for approval.
