,(,jFAJ MALACANANG Manila 27 BY THE PRESIDENT OF THE PHILIPPINES PROCLAMATION NO. 458 RESERVING FOR SOCIALIZED HOUSING DEVELOPMENT CERTAIN PARCELS OF LNSD SITUATED ALONG THE MANGGAHAN FLOODWAY IN THE MUNICIPALITIES OF CAINTA AND TAYTAY, PROVINCE OF RIZAL AND THE MUNICIPALITY OF PASIG, METRO MANILA, ISLAND OF LUZON TRANSFERRING TO THE NATIONAL HOUSING AUTHORITY THE OWNERSHIP OF SAID GOVERNMENT LANDS AND DECLARING THE SAME OPEN FOR DISPOSITION IN FAVOR OF THE QUALIFIED BENEFICIARIES PURSUANT TO REPUBLIC ACT NO. 7279 AND MEMORANDUM ORDER NO. 191 DATED 12 FEBRUARY 1994 Upon the recommendation of the Secretary of the Department of the Environment and Natural R9sources and by virtue of the powers vested in me by law, I, FIDEL V. RAMOS, President of the Republic of the Philippines, do hereby reserve for sociaized housing program purposes in accordance with R.A. No. 7279 and Memorandum Order No. 191 and transferring to the National Housing Authority (NHA) of the titled government lands and issuance of special patent for untitled properties embraced therein and declaring the same open for disposition in accordance with the aforesaid law and ssuance, subject to private rights, if any there be, and likewise subject to future survey, certain parcels of land situated along the Manggahdn Floodway in the Municipalitie of Cainta and Taytay, Province of Rizal and Municipality of Pasig, Metro Manila, Island of Luzon, which parcels are more particularly described as follows: PARCEL I (East Embankment) A PARCEL OF LAND, PARCEL I (Portion of the area expropriated for the Manggahan Floodway Project) EastBank, situated in the Municipalities of Cainta and Taytay, Province of Rizal, and Pasig, Metro Manila, Bounded on the Northeast points 1 to 2, by road dike of the Manggahan, Project, on the Southeast points 2 to 3 by Laguna Lake; on the Southwest points 3 to 4 by the Floodway Channel; and on the Northwest points 4 to 1, by the CaGED II Housing Project. Bounded on the Northeast points 1 to 2 by the FloodwayChannel; on the Southwest points 2 to 3 by road dike of the Manggahan Project; and on the Northeast points 4 to 1, by the Manggahan Channal. Beginning at point marked B.L.L.M. No.1 of Pasi9-, Metro Manila; thence S. 34 deg. 41'E., thence S. 55 deg. 48'E., thence S. 33 deg. 56'W., thence N. 56 deg. 04'E., 5080.00 m. to point 2; 107.42 m. to point 3; 5800.00 m. to point 4; 31.50 m. to point of beginning; containing THOUSANn EIGHT HUNDREDMETERS, more or less. an of NINE area FIFTY FOUR HUNDRED TWO (402,859) SQUARE The disposition of the lots under this Proclamation shall be exempt from public bidding requirements under Act No. 3038. Such part or parts of the area herein declared open to disposition which are being used or earmarked for public or quasi-public purposes shall be excluded from such disposition. Except in favor of the government or any of its branches, units or institutions or agencies, lands disposed of under this Proclamation shall not be subject to alienation and encumbrance for a term of ten (10) years from the issuance of deed of salejconveyence, in case of sale or execution of contract in case of lease, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period except for housing loan purposes; but the improvements on the land may be mortgaged to qualifiedpersons, associations, or corporations. -""" J~""" ~~..,", In order to facilitate the early development of the area 'for disposition, the Department of Environment and Natural Resources, through the Lands Management Bureau, is hereby directed to undertake immediately the boundary, topographic, structural and subdivision surveys. ; Likewise, the Lands Management Bureau shall issue a special patent in favor of the National Housing Authority for all the remaining alienable and disposable v.acant lans for the disposition in accordance with the said issuances. set my hand and Philippines to be IN WITNESS WHEOF, I have hereunto caused the seal of the Republic of the affixed.
