DECLARING AS CIVIL RESERVATION FOR PUBLIC USE FOR VARIOUS BARANGAY DEVELOPMENT PROJECTS, CERTAIN PARCELS OF LAND OF THE PUBLIC DOMAIN SITUATED IN BARANGAY PUNTALINAO, MUNICIPALITY OF BANAYBANAY, PROVINCE OF DAVAO ORIENTAL

Upon recommendation of the Secretary of Environment and Natural Resources and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, do hereby set aside and declare as civil reservation for public use for various barangay development projects, certain parcels of the public domain situated in Barangay Puntalinao, Municipality of Banaybanay, Province of Davao Oriental, Island of Mindanao, subject to private rights, if any there be, which parcels of land are more particularly described as follows:

Parcel I MR-112502-000026, AMD.

A PARCEL OF LAND (Lot No. 1, MR-112502-000026, AMD.), situated in Barangay Puntalinao, Municipality of Banaybanay, Province of Davao Oriental, Island of Mindanao. Bounded on the E., along line 1-2 by Lot 2 of Plan MR-112502-000026 Amd., on the S., along lines 2- 3-4-5-6-7-8-9 by National Highway (60.00 meters wide); on the W., along line 9-10 by Davao Gulf; on the N., along line 10-1 by Davao Gulf.

Beginning at a point marked “1” on plan being N. 55045’ W., 14,967.29 m. from BLLM No. 1, Cad-353-D, thence:

A PARCEL OF LAND (Lot No. 3, MR-112502-000026, AMD.), situated in Barangay Puntalinao, Municipality of Banaybanay, Province of Davao Oriental, Island of Mindanao. Bounded on the NE., along lines 3,-4,-5,-6,-7,-8,-9,-10,-11,-12,-13 by National Highway (60.00 meters wide); and line 13-14 by timberland, on SE., along line 14-1 and SW., along lines 1,-2,-3 and 3,-4 by timberland.

Beginning from point marked “1” on plan being N. 55045’W., 14,367.29 m. from BLLM No. 1, Cad-353-D, Lupon Cadastre, thence:

The administration and management of the area covered by -the reservation shall be under the Local Government of Banaybanay, Davao Oriental, in coordination with the Department of Environment and Natural Resources, and any developmental activity therein should have minimal effect on the ecosystem. For this purpose, a five-year development plan shall be submitted to the Office of the President of the Republic of the Philippines, within one (1) year from the approval hereof, furnishing the Department of Environment Natural Resources through the Forest Management Bureau a copy thereof.

The cutting and utilization of timber and other forest products remaining in the area shall be subject to Forest and Revenue Laws, Rules and Regulations. In the event that the area is no longer needed for the purposes stated herein or its development has already been abandoned for a period of two (2) years, this proclamation is automatically withdrawn/cancelled and the subject area shall be reverted to its regular status as timberland for forest purposes.
