AMENDING PROCLAMATION NO. 188, DATED AUGUST 28, 1937 WHICH RESERVED A PARCEL OF LAND OF THE PUBLIC DOMAIN SITUATED IN BARRIO TINIGUIBAN, CITY OF PUERTO PRINCESA, PROVINCE OF PALAWAN, FOR MILITARY PURPOSES, BY EXCLUDING A CERTAIN PORTION THEREOF AND DECLARING THE SAME OPEN FOR DISPOSITION FOR’ RESIDENTIAL PURPOSES

Upon recommendation of the Secretary of Environment and Natural Resources and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, do hereby amend Proclamation No. 188 dated August 28, 1937 which reserved for military purposes, a certain parcel of land located at Barrio Tiniguiban, City of Puerto Princesa, Province of Palawan, by excluding a certain portion of the land embraced therein and declaring the same open for disposition for residential purposes under the provisions of Commonwealth Act No. 141, as amended, subject to private rights, if any there be, which parcel of land to be excluded is more particularly described as follows:

A PARCEL OF LAND (Lot 2592-A of the subdivision plan, Csd-04-015832, being a portion of Lot 2592, Cad-800-D, Puerto Princesa Cadastre situated in Barrio Tiniguiban, City of Puerto Princesa, Province of Palawan. Bounded of NW., along lines 1-2-3 by Lot 2599; on the NE., along lines 3-4-5 by Lot 2598; on the SE., along line 5-6 by Lot 2597; along lines 6-7-8-9 by Lot 2594, all Cad- 800-D, Puerto Princesa Cadastre, on the SW., along lines 9-10-11 by Lot 2592-B of the subdivision plan; along lines 11-12-13 by Lot 2593, Cad-800-D, Puerto Princesa Cadastre; on the W., alcng line 13-14 by National Highway (20.00 meters wide) and on the NW., along line 14-1 by Lot 2599, Cad-800-D, Puerto Princesa Cadastre. Beginning at a point marked “1” on a plan being N. 19° 38’ W., 4,465.48 meters from BLLM No. 1, Cad-800-D, Puerto Princesa Cadastre to corner 1, thence:

beginning, containing an area of ONE HUNDRED SEVENTY-NINE THOUSAND EIGHT HUNDRED SEVENTY-NINE (179,879) SQUARE METERS. All points referred to on the plan are marked on the ground by B.L. Cyl. corner mons. 15x60 cm. Bearing grid; date of original survey: April 4 to November 12, 1974; and that the subdivision plan on March 4, 1977; and was approved on April 29, 1997.

Such part or parts of the area herein reserved which are being used or earmarked for public or quasi-public purposes, shall be excluded from such disposition.

The Department of Environment and Natural Resources (DENR)-Regional Office IV-MIMAROPA, in coordination with the Housing and Urban Development Coordinating Council (HUDCC) shall supervise the boundary and subdivision survey of the proclaimed area. In the conduct of said survey, the aforementioned offices shall ensure that the areas intended for open space, parks, playgrounds, barangay hall, school site, roads and alleys and for other public or quasi-public purposes is provided for the convenience of the residents thereat.

An Inter-Agency Committee chaired by HUDCC, DENR as Vice-Chair, Presidential Commission for the Urban Poor (PCUP), City Government of Puerto Princesa and a representative of the People’s Organization (PO) in the area as members, is hereby created to formulate the implementing rules and regulations of this proclamation.
