PROCLAMATION NO. 537

EXCLUDING FROM THE OPERATION OF PROCLAMATION NO. 781, SERIES OF 1935, WHICH RESERVED FOR THE PHILIPPINE CONSTABULARY (NOW THE PHILIPPINE NATIONAL POLICE) A PARCEL OF LAND OF THE PUBLIC DOMAIN SITUATED IN THE BARRIO OF TENEGUIBAN (NOW TINIGUIBAN), MUNICIPALITY (NOW CITY) OF PUERTO PRINCESA, PROVINCE OF PALAWAN, A PARCEL OF LAND EMBRACED THEREIN AND DECLARING THE SAME OPEN FOR DISPOSITION AS SOCIALIZED HOUSING SITE UNDER A USUFRUCT SCHEME

WHEREAS, it is the priority concern of the Government to provide housing to homeless Filipinos in line with the constitutional! mandate for the State to protect and advance the right of the people to a balanced and healthful ecology, decent living conditions and social justice;

WHEREAS, mass housing has been reaffirmed by this government as a centerpiece program in its poverty alleviation efforts pursuant to Executive Order No. 20 dated 28 May 2001;

WHEREAS, mass housing may be effected, among others, through the regularization of land tenure of informal settlers on government-owned lands which have not been used for the purposes for which they have been reserved or set aside for the past ten (10) years from the effectivity of Republic Act No. 7279, pursuant to Executive Order No. 131 dated 01 October 2002;

WHEREAS, such initiative showcases this Administration’s seriousness in its anti-poverty strategies, particularly on assets reform that directs the redistribution of physical assets to the poor.

NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Philippines, do hereby declare as excluded from the operation of Proclamation No. 781, series of 1935, which reserved for the Philippine Constabulary (now the Philippine National Police) a parcel of land of the public domain situated in the Barrio of Teneguiban (now Tiniguiban), Municipality (now City) of Puerto Princesa, Province of Palawan, a parcel of land embraced therein and declaring the same open for disposition as socialized housing site under a apa scheme, which tract of land is generally described as follows:

The said parcels of land shall be disposed of under a usufruct scheme between the Philippine National Police (PNP), as the administrator of the property, and the qualified bona fide occupants thereof.

Pursuant to the provisions of Memorandum Order No. 74 dated 13 September 2002, the Housing and Urban Development Coordinating Council (HUDCC) shall assist in the organization of a Local Inter-Agency Committee (LIAC) for the purpose of facilitating and expediting the conduct of post- proclamation activities necessary to dispose of the proclaimed site to their actual bona fide occupants, to the end that these informal settlers are finally granted the titles to the lands they are occupying at the earliest possible time and in order that these lands are developed as a viable community through participatory planning and utilization of appropriate development schemes.
