PROCLAMATION NO._54

DECLARING THOSE PARCELS OF LAND NOT BEING OCCUPIED/USED AS GOVERNMENT CENTER SITE OF THE MUNICIPALITY OF SAN JUAN, METRO MANILA, AS DISPOSABLE AND AVAILABLE FOR AWARD TO ITS PRESENT OCCUPANTS

WHEREAS, the occupants-members of the Homeowners Association of Corazon de Jesus of San Juan, Metro Manila had been occupying those parcels of land, identified as Lot Nos. 1, 4 and 5, inclusive, since time immemorial, as their place of abode and the same parcels of land had not yet been titled nor placed under the operation of the Land Registration Act;

WHEREAS, both Proclamation Nos. 1716 dated February 17, 1978 and 863 dated January 20, 1997 recognized existing private rights over said parcels of land and possessory rights over said parcels of land could now be accorded to herein occupants- members of the homeowners association under existing laws and jurisprudence and said possessory rights had ripen to ownership;

WHEREAS, under the Public Land Act, as amended and existing jurisprudence, the Executive Department is the sole authority and power to dispose of all alienable and disposable lands of the state;

NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, pursuant to the powers vested in me under the Public Land Act and existing jurisprudence and to do justice to the occupants-members of the Homeowners Association of Corazon de Jesus, San Juan, Metro Manila, do hereby revoke Proclamation No. 863 dated January 20, 1997 and without legal effect whatsoever as far as it reserved for future municipal government center site those parcels of land already occupied by said occupants-members and hereby authorize and grant power for the Secretary of Department of Environment and Natural Resources and _ his implementing agencies to dispose and award those parcels of land being presently occupied by the members of said homeowners association, more particularly described as follows:
