REPEALING PROCLAMATION NO. 614, DATED SEPTEMBER 5, 1933, WHICH RESERVED A PARCEL OF LAND OF THE PUBLIC DOMAIN LOCATED IN BARANGAY DUMAGOK, LABANGAN MUNICIPAL DISTRICT (NOW ACTUALLY UNDER THE TERRITORIAL JURISDICTION OF PAGADIAN CITY), ZAMBOANGA DEL SUR, FOR THE USE OF THE PHILIPPINE CONSTABULARY AND DECLARING THE PARCEL OF LAND EMBRACED THEREIN FOR HOUSING SITE PURPOSES OPEN FOR DISPOSITION IN FAVOR OF THE BONA FIDE OCCUPANTS IN ACCORDANCE WITH THE PROVISIONS OF REPUBLIC ACT NO. 7279, OTHERWISE KNOWN AS THE URBAN DEVELOPMENT AND HOUSING ACT

Upon recommendation of the Secretary of Environment and Natural Resources, and pursuant to the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, do hereby repeal Proclamation No. 614, series of 1933, which reserved a parcel of land of the public domain located in Barangay Dumagok, Labangan Municipal district (now actually under the territorial jurisdiction of Pagadian City), Zamboanga Del Sur for the use of the Philippine Constubulary, and declaring the parcelof land embraced therein for housing site purposes open for disposition in favor of the bona fide occupants in accordance with the provisions of Republic Act No. 7279, otherwise known as the Urban Development and Housing Act, subject to private rights, if any there be, and to final survey, which parcel of land is more particularly described as follows:

A PARCEL OF LAND described in Bureau of Lands plan-Ir- 303, situated in the Barrio of Dumagok, Municipal District of Labangan, Province of Zamboanga, Island of Dumagok (now Pagadian City, Zamboanga Del Sur). Bounded on all sides by Pagadian Bay.

Beginning at a point marked “1” on plan Ir-303, S. 23° 23’ W, 1,361 m., more or less, from B.L.L.M. No. 1, barrio of Pagadian, municipal district of Labangan, thence:

containing an area of NINETY FIVE THOUSAND ONE HUNDRED FIFTY THREE (95,135) SQUARE METERS, more or less.

Points 1 and 2, P.L.S. concrete monuments; points 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, and 15, stakes; points 9 and 12, crosses Cut on trees points 1 to 15, inclusive, on shore of Pagadian Bay. Points referred to marked on plan Ir-303. Bearings true. Declination 1° 37’ E. Surveyed, July 14-15, 1931, Approved, December 24, 1931.

The Secretary of Environment and Natural Resources is hereby authorized to issue a Special Patent covering the area herein reserved for

socialized housing purposes in favor of the National Housing Authority (NHA).

The NHA shall reimburse the national government the value of the land after the final payment of the areas reserved for socialized housing purposes by the qualified beneficiaries.

Such parts of the area herein declared open to disposition which are being used or earmarked for public or quasi-public purposes shall be excluded from such disposition.

A Local Inter-Agency Committee (LIAC) is hereby created to formulate a comprehensive housing development plan for the area, cause final survey to be undertaken, draw up and adopt guidelines for beneficiary selection and land pricing and implement the appropriate disposition scheme. Council as Co-Chair, the DPWH as Vice Chair, and the Department of Environment and Natural Resources, Presidential Commission on Urban Poor, and the representative of the homeowners association, as members. The LIAC shall formulate and adopt the Implementing Rules and Regulation of this Proclamation.
