PROCLAMATION NO. 653

AMENDING PROCLAMATION NO. 26 DATED JULY 9, 1920, WHICH RESERVED CERTAIN PARCELS OF LAND, LOCATED IN BRGY. SAGPON, DARAGA, ALBAY FOR SCHOOL PURPOSES, BY SEGREGATING A PORTION OF THE LAND EMBRACED THEREIN AND RESERVING THE SAME FOR HOUSING PURPOSES OPEN FOR DISPOSITION IN FAVOR OF THE ACTUAL OCCUPANTS

Upon recommendation of the Secretary of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, do hereby amend Proclamation No. 26 dated July 9, 1920, which reserved certain parcels of land, located in Brgy. Sagpon, Daraga, Albay for school purposes, by segregating a portion of the land embraced therein and reserving the same for housing purposes open for disposition in favor of the actual occupants, subject to private rights, if there be any, and to final survey, which parcel of land is more particularly described as follows:

A PARCEL OF LAND (portion of Lot 17992, Cad-56, Albay Cadastre), situated in Barangay 2, (EM’s Barrio South), City of Legazpi, Island of Luzon. Bounded on the NE., along lines 24-25-26-27-28-29-1-2- 3-4 by Lot 17992 (portion); on the SE., along line 4-5 by Lot 9608, Cad- 56, Albay Cadastre; on the SE., S., SW., along lines 5-6-7-8-9-10-11-12- 13 by Creek; and on the N. and NW., along lines 13-14-15-16-17-18-19- 20-21-22-23-24 by an existing road (portion of Lot 17992, Cad-56, Albay Cadastre).

Beginning at a point marked “1” on the plan being N. 65 deg. 36’ E., 551.56 m. from BBM No. 62, Cad-56, Albay Cadastre, thence:

S. 41 deg. 45’ E., 40.33 m. to point 2;

S. 89 deg. 07’ E., 19.40 m. to point 3;

beginning, containing an area of SEVENTEEN THOUSAND FOUR HUNDRED SEVENTY SIX (17,476) SQUARE METERS, more or less.

The area herein reserved for socialized housing purposes shall be disposed of in accordance with the provisions of RA 7279 known as the Urban Development and Housing Act and shall be under the administration of the Housing and Urban Development Coordinating Council (HUDCC)/ National Housing Authority (NHA).

For this purpose, an Inter-Agency Committee with Housing and Urban Development Coordinating Council (HUDCC) as Chair, the Local Government Unit (LGU) as Vice-Chairman with representatives from the National Housing Authority and the Department of Environment and Natural Resources and the Homeowners Association as members is hereby created to formulate implementing rules and regulations of the proclamation.

Such part or parts of the area herein declared as housing site, which are being used or earmarked for public or quasi-public purposes: shall be excluded from such disposition. Except in favor of the Government or any of its branches or gt ag all lands disposed of pursuant to this proclamation shall not be

subject to alienation and encumbrance for a period of ten (10) years from the issuance of the title in case of sale or execution of contract in case of usufruct, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of the said period; but the improvements on the land may be mortgaged to qualified persons, associations, partnerships or corporations.

The Department of Environment and Natural Resources is hereby authorized to issue Special Patent in favor of the National Housing Authority covering the area herein reserved for socialized housing purposes.

This Proclamation is subject to the minimum road right of way requirements of the Department of Public Works and Highways pursuant to EO No. 621.
