BY THE PRESIDENT OF THE PHILIPPINES PROCLAMATION NO. 772

AMENDING PROCLAMATION NO. 483 DATED OCTOBER 28, 1968, WHICH RESERVED A PARCEL OF LAND LOCATED IN POBLACION, TAGUM CITY FOR CHILDREN’S PARK AND PLAYGROUND PURPOSES BY GRANTING OWNERSHIP OF THE SAME IN FAVOR OF THE CITY GOVERNMENT OF TAGUM

Upon recommendation of the Secretary of Environment and Natural Resources, and by the virtue of the powers vested in me by the law, I, GLORIA MACAPAGAL ARROYO, President of the Republic of the Philippines, do hereby amend Proclamation No. 483 dated October 28, 1968, which reserved a parcel of land located in Poblacion, Tagum City for children’s park and playground purposes by granting ownership of the same in favor of the City Government of Tagum, subject to private rights, if any there be, which parcel of land is more particularly described as follows:

A PARCEL OF LAND (Lot 1330, Cad 276, Tagum Cadastre), located in Poblacion, Tagum City, Province of Davao del Norte, Island of Mindanao. Bounded on the NE., along line 10-11 by Lot 485; on the SE., along line 11-12 by Lot 396; along line 12-1 by Lot 397, all of Cad-276; on the SW., along lines 1-2-3 by Municipal Road; and on the NW., along lines 3-4-5-6-7-8-9-10 by Lot 485, Cad-276. Beginning at a point marked “1” on plan, being S. 82 deg. 14’ E 399.21 m. from BLLM No. 2, Cad-276, Tagum Cadastre, thence:

The tract of land herein reserved shall be non-alienable nor be subject to occupation, entry, sale, lease or any other mode of disposition until again declared by proclamation of the President.

WHEREAS, on October 28, 1968, Proclamation No. 483 was issued by then President Ferdinand Marcos reserving a parcel of land located in the Municipality of Tagum (now Tagum City) for children’s park and playground purposes under the administration of the Municipality of Tagum;

WHEREAS, the parcel of land covered by Proclamation No. 483 is identified as Lot 1330, Cad-276, containing an area of Thirteen Thousand Eight Hundred Forty Eight (13,848) square meters, more or less;

WHEREAS, the City Government of Tagum actually and currently utilizes the abovecited parcel of land as children’s park and playground;

WHEREAS, the children’s park and playground is one of the basic facilities of the City Government of Tagum intended for the enjoyment of its inhabitants;

WHEREAS, the City Planning and Development Coordinator certified that the said tract of land is within the institutional zone as per approved Revised Land Use Plan of Tagum City;

WHEREAS, pursuant to the provision of Section 22 of R.A. 7160 otherwise known as the Local Government Code, the City of Tagum as a city corporation is vested with corporate power to acquire real or personal property.

NOW THEREFORE, KNOW YE, that by authority vested upon me by the Constitution of the Philippines, and in conformity with the provisions thereof and of R.A.7160 otherwise known as the Local Government Code, supplemented by Commonwealth Act No. 141, as amended, otherwise known as the Public Land Act, there is hereby granted and conveyed unto the City Government of Tagum, the aforesaid parcel of land located in Poblacion, City of Tagum, Province of Davao del Norte, Island of Mindanao, identified and more particularly described as Lot No. 1330, Cad-276, containing an area of Thirteen Thousand Eight hundred Forty Eight (13,848) square meters, more or less, the technical description of which are as follows:

TO HAVE AND TO HOLD, the said tract of land, with the appurtenances thereunto belonging to the City Government of Tagum and its successors-in- interest or assigns forever, subject to the condition that the parcel of land shall be used only for the purpose authorized in Proclamation No. 483 dated October 28, 1968.
