Be it enacted by the Senate and House of Representatives of the Philippine Congress Assembled:

Section 1

Section thirty-eight of Commonwealth Act Numbered Fifty-eight, known as the Charter of the City of Cebu, as amended by Commonwealth Act Numbered One hundred and twenty-nine and by Republic Act Numbered Sixty-seven, is hereby amended to read as follows:

"Sec. 38. Regular and acting judges of the Municipal Court. - There shall be a Municipal Court for the City of Cebu consisting of two branches, for which two judges shall be appointed, to be known, respectively, as judge of the first and second branch, and who shall receive salaries of four thousand pesos each.

"The first branch shall have exclusive jurisdiction in criminal cases and the second branch, in civil cases and in juvenile delinquencies.

"The Municipal Court shall have the same jurisdiction in civil and criminal cases and the same incidental powers as at present conferred by law upon justice of the peace courts and such additional jurisdiction and powers as may hereafter be conferred upon them by law.

"In case of absence, sickness or incapacity of any of the judges of the Municipal Court and in case of any vacancies in such offices, the Secretary of Justice may designate any assistant fiscal in the office of the provincial fiscal of Cebu to act as judge of the Municipal Court of the City of Cebu, with all the powers of a regular judge of said court, by such acting judge shall not receive any additional compensation during the time he is acting as such."

Section 2

This Act shall take effect upon its approval.
